These Terms of Service ("Terms") govern your access to and use of the iRacing Masters Series website and related services (the "Service"), operated by BeingIT® ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Description of Service
The Service provides information and tools related to the iRacing Masters Series sim-racing league, including but not limited to:
- Season registration and entry management
- Race schedules, results, and standings
- Driver and league information
- Community links and notifications
- Administrative features for authorised users
The Service is provided for recreational sim-racing league participation and is not affiliated with or endorsed by iRacing.com Motorsport Simulations, LLC, except where league data is sourced through iRacing's platform.
Eligibility
You must be at least 18 years old to register for a league season or create an account. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.
You are responsible for maintaining your own valid iRacing subscription and equipment needed to participate in league events.
User Accounts
Some features require you to sign in, including via Google authentication. You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorised access
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.
League Registration and Fees
Season entry may require payment of a registration fee. By submitting an entry:
- You agree to provide accurate registration information
- You agree to pay any applicable fees using the payment methods offered (such as PayFast, PayPal, or EFT)
- You understand that entry fees are generally non-refundable except where required by law or explicitly stated otherwise
- You agree to abide by league rules, schedules, and sporting conduct expectations described on the About page and related documentation
We reserve the right to accept, decline, or remove entries at our discretion, including for incomplete payment, inaccurate information, or conduct inconsistent with league standards.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false, misleading, or impersonated information
- Attempt to gain unauthorised access to the Service, other accounts, or related systems
- Interfere with or disrupt the Service, including through automated scraping, denial-of-service activity, or introduction of malware
- Harass, abuse, or harm other users or league officials
- Use the Service to distribute spam or unsolicited communications
- Reproduce, redistribute, or commercially exploit Service content without our prior written consent
We may investigate violations and take appropriate action, including removing content, revoking access, or reporting activity to relevant authorities.
Intellectual Property
The Service, including its design, text, graphics, logos, and software, is owned by BeingIT® or its licensors and is protected by applicable intellectual property laws.
League results, standings, and related data may incorporate information from iRacing and other third-party sources. Third-party trademarks and service marks are the property of their respective owners.
You may not copy, modify, distribute, or create derivative works from Service content except as permitted by law or with our express written permission.
Third-Party Services and Links
The Service may integrate with or link to third-party services, including Google, iRacing, PayFast, PayPal, WhatsApp, Discord, and YouTube. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, content, or practices.
Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Results, standings, or schedules will always be accurate or up to date
- Any defects will be corrected
Sim-racing league participation carries inherent risks related to software, hardware, and network connectivity. You participate at your own discretion.
Limitation of Liability
To the fullest extent permitted by applicable law, BeingIT® and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from:
- Your use of or inability to use the Service
- Any conduct or content of third parties on or through the Service
- Unauthorised access to or alteration of your data
- League events, race incidents, or decisions by race officials
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us for league entry in the twelve (12) months preceding the claim, or one hundred South African Rand (ZAR 100), whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless BeingIT® and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your league participation, your violation of these Terms, or your violation of any rights of another person or entity.
Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service or other users.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of South Africa for disputes arising from these Terms or the Service, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
Changes to These Terms
We may revise these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
